Welcome to outstudy. These Terms of Service (the "Terms") are a legal agreement between you and outstudy and govern your use of the outstudy website and app at outstudy.ca (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
You must be at least 13 years old to use outstudy. If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has consented to your use of the Service on your behalf.
You agree not to:
You retain ownership of anything you upload, including subject names, group room details, descriptions, and avatar images ("Your Content"). By uploading Your Content, you grant outstudy a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit it strictly as needed to operate the Service — for example, showing your avatar on the leaderboard or your subject in a group room. This license ends when you delete Your Content or your account, except where retention is required by law.
You represent that Your Content does not infringe anyone else's rights and that you have the right to upload it.
Group rooms let you study alongside other users in real time. Room creators are responsible for the rooms they create. Be respectful to other members. We may remove rooms, content, or members that violate these Terms.
outstudy is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that any data you store will never be lost.
To the maximum extent permitted by law, outstudy and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or in connection with your use of the Service. Our total liability to you for any claim relating to the Service is limited to the amount you have paid us for the Service in the twelve months before the claim (which, while the Service is free, is zero).
We are actively developing outstudy. We may add, change, or remove features, and we may limit access to parts of the Service for maintenance or legal reasons. We will try to give reasonable notice of significant changes.
You can stop using the Service at any time, and you can permanently delete your account from Settings → Danger zone. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we reasonably believe your account poses a risk to other users or to the Service. Sections that by their nature should survive termination (including Sections 6, 7, 10, and 11) will survive.
These Terms are governed by the laws of the Province of Ontario, Canada, and the applicable federal laws of Canada, without regard to conflict of law principles. You agree that the courts located in Ontario, Canada will have exclusive jurisdiction over any dispute arising out of or relating to these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction.
We may update these Terms from time to time. If we make material changes, we will revise the "Effective" date above and, where appropriate, notify you in the app. By continuing to use outstudy after changes take effect, you agree to the updated Terms.
